Terms of Service

1. General provisions

These Terms govern the use of the MotPat web application (the “App”), available at motpat.com, operated by Maksymilian Nowak (the “Operator”, “we”).

By using the App or creating an account, you accept these Terms. If you do not agree with them, do not use the App.

2. Definitions

User — a person using the App. Account — an individual User profile. Motek — the AI assistant feature that supports goal planning. Content — goals, steps, descriptions and other data entered by the User.

3. Nature and scope of the service

MotPat is a tool for turning goals into a list of small steps, with gamification (streaks, XP, levels, badges, a league) and an AI assistant. The App is provided electronically.

The App is currently provided free of charge and in a development version (“beta”). This means features may change and interruptions or bugs may occur.

4. Account and terms of use

Full functionality requires creating an Account with an email address. You agree to provide a valid email address and to protect your login credentials. You are responsible for actions taken under your Account.

The Account is intended for people aged 16 or older. Younger people may use the App only with the consent of a legal guardian.

5. User Content

You retain the rights to the Content you enter. You grant us only a limited license necessary to store and display your Content in order to provide the service.

You are responsible for the Content you enter and agree not to post unlawful, offensive Content or Content that infringes the rights of third parties.

6. AI assistant (Motek)

Motek generates suggestions automatically and can be wrong. Proposed steps, plans and advice are for informational and supporting purposes only. Always verify them yourself — especially on matters of health, finance, law or safety.

To work, the AI features may send the text you enter to an external language-model provider. Do not enter sensitive or confidential data into the App.

7. Prohibited actions

You agree not to:

  • violate the law or the rights of third parties;
  • disrupt the App or bypass its safeguards or limits (including AI request limits);
  • use the App in an automated way without our consent (scraping, bots);
  • attempt unauthorized access to other Users' accounts.

8. Availability and liability

We make efforts to keep the App working correctly; however, to the extent permitted by law, it is provided “as is”, without a guarantee of uninterrupted availability.

To the extent permitted by law, we are not liable for decisions made based on Content or AI suggestions, for data loss, or for indirect damages. This provision does not limit consumer rights arising from mandatory law.

9. Personal data and privacy

We process personal data in accordance with the GDPR. To run the App we use, among others, hosting and database services, cookieless analytics and an error-monitoring tool. Details are described in the Privacy Policy.

10. Termination and account deletion

You may delete your Account at any time in the App settings, which is equivalent to terminating the agreement. Deleting the Account permanently removes the associated Content.

We may suspend or delete an Account in the event of a material breach of these Terms, while respecting the User's rights.

11. Complaints

You can report complaints about the App to motpat@proton.me. We will respond within a reasonable time, no longer than 30 days.

12. Changes to the Terms

We may update the Terms, e.g. due to the App's development or changes in law. We will notify you of material changes in the App or by email. Continued use of the App after the changes take effect constitutes acceptance.

13. Final provisions

Matters not regulated herein are governed by Polish law. Any disputes with consumers are resolved in accordance with generally applicable law. Consumers may use out-of-court complaint and redress procedures, including the European Commission's ODR platform.
